Auctions and you must certify that you are an adult and have met the
qualifications to enter into this Agreement.

Cyclone Music Auctions cannot and does not control
the quality, safety, legality or accuracy of any item listed or any
item description. Trading over the Internet has certain inherent risks;
I understand these risks exist and will do everything that I can to
minimize the risk of fraud.

I will not provide fraudulent information
and I am solely responsible for any information I provide to Cyclone
Music Auctions. I will comply with all laws applicable to my activities
on the web site and with this Agreement. I will not sell any prohibited,
illegal or infringing items on Cyclone Music Auctions and I will not do
anything that will interfere with the proper working of the Cyclone
Music Auctions web site.

my rights to collect damages from Cyclone Music for operating the web
site and providing its service and that if I violate this Agreement I
may be liable to pay Cyclone Music for the damages caused by my

Are There Fees?
If you want to bid or browse at Cyclone Music Auctions or Exact
Replicas, it's free. You don't pay a penny in fees.
If you're a seller, you'll be charged:
- An insertion fee. This fee is a
flat rate. ( See chart below)
- There are NO Final Value (final
sale price) fees at the end of your auction.
- The only fee will be for the uploading
to the auction site and this fee is non-refundable.

minimum or reserve price will increase in increments of $1.00 for
postings unless you specify otherwise. NOTE: Once billed for the
reserve price you will owe nothing else. You will also be responsible
for any taxes or duties that are acquired from your sale.

sellers, completed auctions. Just enter in your item in the search box
at the top of the page and click the "Search".

New to Bidding?
To start bidding, you'll first need to
register at no charge as an Cyclone Music Auction member. Then let the
fun begin! Here's what to do:
- Once you register,
find an item you'd like to bid on by browsing through Cyclone Music
Auction listings. Or, you can try a search for a specific item.
- When you find something you want, scroll
to the bottom of the item's page until you see the bidding area.
Enter the amount of your bid, and click the "review bid"
button.
- Carefully look over what you're
bidding on, enter your User ID and password and then click the
"place bid" button. Bidding is now complete and
you're off to the races!
- As you wait for the auction to close
(this is usually several days), you'll receive a daily email telling
you if you're the high bidder or if you've been outbid by another
Cyclone Music Auction member.
- Going, going, gone! When the auction
closes, if you are the high bidder, you must email the seller within
three business days to claim your item. Congratulations—you're a
winner!

I've
won or sold an item - now what?
So you've won your auction, or you've sold an item. Now what do you do?
Your first move is to contact the other
person in the transaction. Sellers should try to contact the winning
bidders within three business days after the auction ends. Winning
bidders should also contact the sellers, especially if they haven't
heard back from the seller within three business days. Sellers will not
be offended if you show enthusiasm for the item that you bought. It is
the responsibility of the seller and the buyer to contact one another.
When the auction has ended, sellers
should contact the winning bidder's) (usually within three business
days) with information on the total cost, including shipping, and where
to send payment. The winning bidder's) pays the seller directly for the
item(s), and it is the seller's responsibility to fulfill the order when
payment terms are met. The binding contract of the auction is between
the winning bidder and the seller.
A seller may contact the next-highest
bidder if the seller is unable to conclude the transaction with the
high-bidder within 3 business days. Therefore, high-bidders may lose
their place as winning bidder if the high-bidder does not contact the
seller within 3 business days of the end of the auction.

Privacy.
Our primary goal in collecting personal information from you is to
provide you with a smooth, efficient, and customized experience while
using our services. This allows us to provide services and features that
most likely meet your needs, and to customize our service to make your
experience easier and quicker.
To fully use our services, you will need to register using our online
registration form, where you will be required to provide us with your
contact information and other personal information as described in our
privacy appendix. You may provide us with a User ID; if you don't, we
will use your email address as your User ID. Under some circumstances,
such as if you are registering using an email account at a free email
service, we require some additional information, including billing
address, credit card number and credit card expiration date. We use this
credit card information to verify your name, address, and other
information.
If you send us personal correspondence, such as emails or letters, or if
other users or third parties send us correspondence about your
activities or postings on the Site, we may collect such information into
a file specific to you.
If you choose to sell an item, we will use your credit card information,
address and billing information to provide associated support and to
post your item (s).
Our Disclosure of Your Information.
Unfortunately, due to the existing regulatory environment, we cannot
ensure that all of your private communications and other personally
identifiable information will never be disclosed in ways not otherwise
described in this Privacy Policy. By way of example (without limiting
the foregoing), we may be forced to disclose information to the
government or third parties under certain circumstances, or third
parties may unlawfully intercept or access transmissions or private
communications. We can (and you authorize us to) disclose any
information about you to law enforcement or other government officials
as we, in our sole discretion, believe necessary or appropriate, in
connection with an investigation of fraud, intellectual property
infringements, or other activity that is illegal or may expose us to
legal liability. Further, we can (and you authorize us to) disclose you
UserID, name, street address, city, state, zip code, country, phone
number, email, and company to Cyclone Music Program participants as we
in our sole discretion believe necessary or appropriate in connection
with an investigation of fraud, intellectual property infringement,
piracy, or other unlawful activity. Therefore, although we use industry
standard practices to protect your privacy, we do not promise, and you
should not expect, that your personally identifiable information or
private communications will remain private.
As a general proposition, we do not sell
or rent any personally identifiable information about you to any third
party.

Control of Your Password.
Except as specifically permitted by this section, you may not disclose
your Cyclone Music Auction password to any third parties nor share it
with any third parties. If you lose control of your password, you may
lose substantial control over your personally identifiable information
and may be subject to legally binding actions taken on your behalf.
Therefore, if your password has been compromised for any reason, you
should immediately change your password. Your pass code may at anytime
be removed, changed, deleted, modified at any time with out notice by
Cyclone Music Administration, and webmaster
